CUSTOMER SUMMARY
These Terms & Conditions govern the sale, delivery, and risk associated with all live aquatic food organisms supplied by Jack's Aquatics.
Due to the perishable biological nature of live goods, specific conditions and limitations apply.
This summary is provided for clarity only. The full Terms & Conditions below are legally binding and take precedence in all circumstances.
LIVE AQUATIC FOOD ORGANISMS — DELIVERY, RISK & REPLACEMENT OVERVIEW
Please read before ordering live aquatic food organisms.
Jack's Aquatics supplies live aquatic organisms strictly as feed and biological livestock.
Live goods are perishable and sensitive to transport conditions. Transit always carries inherent biological risk.
DELIVERY OPTIONS — WHAT IS INCLUDED
- Royal Mail Tracked 24
Covers postage only.
Does not include replacement cover.
Does not include refunds or compensation.
Orders sent without Replacement Insurance are dispatched at the Customer's risk once handed to the carrier. - Royal Mail Special Delivery Guaranteed by 1pm
Covers postage only.
Provides a time-guaranteed service.
Does not include replacement cover unless Replacement Insurance is purchased.
Delivery services are postal services only. They do not include replacement entitlement unless a valid Insurance Tier has been added.
REPLACEMENT INSURANCE (OPTIONAL ADD-ON PRODUCT)
Replacement Insurance is an optional paid product.
Without it, no replacement will be considered once goods have been dispatched.
Insurance must match the total live goods order value. Under-insuring may limit or reduce replacement eligibility.
If all Terms are complied with, Replacement Insurance provides:
- One replacement maximum per order
- Extended inspection window of four hours
- Limited missed delivery consideration depending on delivery service
- Coverage subject to Insurance Tier limits and delivery method caps
Replacement Insurance:
- Applies to one order only
- Is single-use
- Does not roll over
- Does not refund postage or insurance fees
- Does not guarantee delivery success
RECIPIENT ATTENDANCE
Live goods require in-person receipt.
If you miss a delivery, redirect the parcel, authorise a safe place, or allow third-party acceptance — you accept full transit risk.
Safe places are not suitable for live goods. Loss or theft from a safe place is excluded.
INSPECTION REQUIREMENTS
Orders must be inspected immediately upon delivery.
Inspection windows:
- Two hours for standard orders
- Four hours for insured orders
Inspection means opening the parcel and checking the contents.
Failure to inspect within the applicable window voids replacement eligibility.
EVIDENCE REQUIREMENTS
All claims require:
- One continuous, unedited video
- Minimum fifteen seconds per affected container
- Original packaging shown first
- Contents clearly visible and undisturbed
Still images, edited clips, screenshots, or partial recordings are not accepted.
Removing items from original packaging before recording voids replacement eligibility.
REFUND POLICY
Refunds are not issued for live goods.
Where Replacement Insurance applies and all conditions are met, replacement is the sole remedy.
Goodwill gestures do not create precedent.

FULL TERMS & CONDITIONS (LEGALLY BINDING)

1. DEFINITIONS & INTERPRETATION
1.1 "We", "Us", "Our" refers to Jack's Aquatics, trading as Jack's Aquatics.
1.2 "Customer" refers to any individual, sole trader, partnership, company, institution, or other entity placing an order with Jack's Aquatics.
1.3 "Products" means all goods supplied by Jack's Aquatics, whether live or non-live, including but not limited to live aquatic organisms supplied as biological livestock or feed organisms, dry feeds, frozen feeds, supplements, treatments, kits, tools, accessories, equipment, electrical items, bundled products, Digital Products, and any associated components or parts, whether supplied directly or via third-party fulfillment.
1.3A Live aquatic organisms supplied by Jack's Aquatics are sold strictly as biological livestock or feed organisms and are not sold or represented as pets or ornamental specimens.
1.4 "Dispatch" means the point at which the order is physically handed to a third-party carrier or collection agent for onward delivery.
1.5 "Delivery" means the first attempted delivery as officially recorded by the carrier tracking system, including the carrier's timestamp and status update.
1.6 "Replacement Insurance" means an optional, paid, contractual replacement service offered by Jack's Aquatics as a separately purchasable Product. Replacement Insurance does not constitute carrier insurance, postal insurance, statutory consumer protection, or a guarantee of delivery or survival. Replacement Insurance is a limited contractual remedy and does not constitute insurance, indemnity, or financial protection under UK insurance law.
1.7 Headings are for convenience only and do not affect interpretation.
1.8 "Inspection Window" means the time period beginning at the official carrier delivery timestamp within which the Customer must inspect the Products and submit a valid claim in accordance with these Terms.
1.9 "Safe Place" means any location authorised by the Customer for delivery without in-person receipt, including but not limited to porches, sheds, garages, behind gates, with neighbors, or any unattended location.
1.10 "Missed Delivery" means a failed delivery attempt due to recipient unavailability at the delivery address.
1.11 "Returned to Sender" means any parcel returned to Jack's Aquatics by the carrier due to failed delivery, refusal, address error, or non-collection.
1.12 "Insurance Tier" means the applicable replacement value band selected by the Customer at the time of purchasing Replacement Insurance, based on total live goods order value.
1.13 "Under-Insured" means a circumstance where the Replacement Insurance tier selected does not correspond to the full live goods order value, which may result in reduced or declined replacement consideration.
2. DELIVERY OPTIONS AND OPTIONAL REPLACEMENT INSURANCE
2.1 All delivery services offered by Jack's Aquatics are third-party postal delivery services only.
2.2 Payment for any delivery option covers postage and handling only and does not include any entitlement to refunds, replacements, or compensation unless a valid Replacement Insurance Product has been purchased for that order.
2.3 Special Delivery Guaranteed by 1pm covers postage only and does not include replacement, refund, or compensation unless Replacement Insurance has been validly purchased.
2.4 Replacement consideration is available only where applicable Replacement Insurance has been purchased and all conditions within these Terms are met in full.
2.5 Replacement Insurance is offered in Insurance Tiers based on total live goods order value and must correspond to the full live goods value of the order.
2.6 The applicable Insurance Tier determines the maximum replacement value available under the relevant delivery service and is subject to the limits and caps set out in Sections 12 and 13.
2.7 Replacement Insurance entitles the Customer to one replacement only per order, subject to full compliance with all inspection, evidence, delivery, and attendance requirements.
2.8 Replacement Insurance does not refund or reimburse postage costs under any circumstances.
2.9 Replacement Insurance is non-transferable, single-use, applies only to the order it was purchased with, has no monetary value if unused, and cannot be transferred to future orders.
2.10 Failure to comply with any requirement within these Terms voids Replacement Insurance eligibility for that shipment.
2.11 SUBSCRIPTION PRODUCTS
2.11.1 Where Products are supplied under a recurring subscription arrangement, billing occurs monthly in advance.
2.11.2 Each dispatch under a subscription constitutes an individual shipment within the active billing cycle.
2.11.3 Where Replacement Insurance is selected as part of a subscription, the insurance fee is billed monthly in advance and applies only to eligible shipments dispatched within the active paid billing cycle in which the insurance was purchased.
2.11.4 Replacement Insurance under a subscription is limited to one replacement maximum per billing cycle, regardless of the number of shipments dispatched within that cycle.
2.11.5 Cancellation of a subscription must occur prior to the next billing renewal date. No partial month refunds are issued for live biological Products.
2.11.6 Failure to comply with inspection, attendance, or evidence requirements voids eligibility for replacement consideration for that shipment only and does not affect future scheduled shipments within the billing cycle.
2.11.7 Where a Customer selects an Insurance Tier that does not correspond to the full live goods order value for a subscription shipment, that shipment shall be treated as Under-Insured and any replacement consideration shall be limited to the maximum value of the Insurance Tier purchased.
3. SCOPE, ACCEPTANCE AND LEGAL EFFECT
3.1 These Terms govern all orders, Products, services, subscriptions, Digital Products, communications, delivery methods, Replacement Insurance options, replacements, and disputes between Jack's Aquatics and the Customer.
3.2 By placing an order, the Customer confirms that they have read these Terms in full, understand the biological and logistical risks associated with the Products, and accept the exclusions, limitations, and conditions set out herein. These Terms constitute the entire agreement between the parties in relation to the sale and supply of the Products.
3.3 No verbal, written, or implied statements, representations, or assurances outside these Terms shall be binding unless expressly confirmed in writing by an authorised representative of Jack's Aquatics.
3.4 These Terms apply equally to all Products supplied now or in the future, including Products fulfilled directly by Jack's Aquatics, fulfilled via third-party suppliers, manufacturers, distributors, or fulfillment partners, or supplied on a drop-ship, direct-to-consumer, or third-party dispatch basis, unless expressly stated otherwise in writing.
3.5 The Customer acknowledges that fulfillment method does not alter risk allocation, liability limitations, exclusions, inspection obligations, or remedies unless expressly stated in writing by Jack's Aquatics.
3.6 AUTOMATED EMAILS AND COMMUNICATIONS
3.6.1 Jack's Aquatics may send automated emails related to orders, subscription updates, Digital Product access, account activity, newsletters, promotions, and educational content. Customers must ensure they provide accurate contact details and accept responsibility for monitoring their email account, including spam and junk folders.
3.6.2 By placing an order or creating an account, the Customer consents to receive such communications and acknowledges that Jack's Aquatics is not liable for missed communications, filtering, blocking, or delivery failures outside its reasonable control.
4. NATURE OF GOODS — LIVE BIOLOGICAL FEED
4.1 Live Products supplied by Jack's Aquatics are live, perishable biological organisms.
4.2 Live Products are supplied strictly as biological livestock or feed organisms and are not sold or represented as pets or ornamental specimens.
4.3 Due to their biological nature, Live Products are not sold with any guarantee of longevity, continued viability, performance, reproductive success, or survival beyond the point of Delivery.
4.4 Live Products are environmentally sensitive and may be affected by factors including, but not limited to, temperature fluctuation, oxygen availability, handling stress, transit vibration, water conditions, acclimation practices, and postal delays.
4.5 The Customer acknowledges that even under optimal packing and shipping conditions, inherent biological mortality risk exists.
4.6 The Customer accepts full responsibility for appropriate acclimation, system preparation, and environmental conditions following Delivery.
4.7 NON-LIVE PRODUCTS
4.7.1 Jack's Aquatics also supplies non-live Products including dry feeds, frozen feeds, kits, tools, equipment, accessories, and related items.
4.7.2 Non-live Products may be sensitive to storage conditions, installation method, compatibility, handling, or misuse. The Customer is responsible for ensuring suitability for their specific system prior to purchase.
4.7.3 Nothing in this Section excludes or limits statutory rights in relation to non-live Products where such rights cannot be excluded by law.
5. STATUTORY CONSUMER RIGHTS
5.1 Nothing in these Terms excludes or limits any statutory rights available to a Customer under the Consumer Rights Act 2015, the Consumer Contracts Regulations 2013, or any other applicable legislation.
5.2 In accordance with Regulation 28 of the Consumer Contracts Regulations 2013, the statutory 14-day cancellation right does not apply to live perishable goods once Dispatch has occurred, and such Products are non-returnable.
5.3 Where a statutory remedy applies, Jack's Aquatics will comply with its legal obligations. Any remedy offered beyond statutory minimum requirements is provided contractually, is conditional upon compliance with these Terms, and does not constitute an admission of fault or liability.
5.4 For non-live consumable Products, returns, cancellations, or remedies may be restricted where goods have been sealed, opened, used, installed, partially consumed, contaminated, or otherwise rendered unsuitable for resale, in accordance with applicable consumer legislation.
5.5 For non-consumable Products, the Customer is responsible for ensuring compatibility, correct installation, correct use, and suitability prior to purchase. Incorrect selection, misuse, improper installation, or incompatibility does not constitute a defect or fault under these Terms.
6. TRANSFER OF RISK AND TITLE
6.1 For consumer Customers, risk in the Products transfers when the Products are delivered to the Customer or a person identified by the Customer to take possession of them, as evidenced by carrier tracking records.
6.2 For business Customers, risk transfers at Dispatch.
6.3 Title to the Products transfers at Dispatch.
6.4 Where Replacement Insurance has not been purchased, Jack's Aquatics bears no liability for delay, environmental exposure, transit handling conditions, or biological deterioration occurring during carriage once the Products have been handed to the carrier, except where required by statutory law.
6.5 Where Replacement Insurance has been purchased, replacement consideration remains subject strictly to the inspection, evidence, attendance, and Insurance Tier conditions set out in these Terms.
7. DELIVERY SERVICES AND CUSTOMER RESPONSIBILITY
7.1 Delivery time-frames and estimates are provided in good faith but are not guaranteed and do not constitute a contractual delivery deadline unless expressly agreed in writing.
7.2 The Customer is responsible for selecting an appropriate delivery option, ensuring recipient availability at the delivery address, and providing accurate and complete delivery information at the time of ordering.
7.3 Failure to select an appropriate delivery service, failure to ensure recipient availability, or provision of inaccurate delivery information does not transfer liability to Jack's Aquatics.
7.4 Where Products are supplied via third-party fulfillment partners, delivery estimates, packaging methods, and dispatch timings may vary. Such variation does not constitute breach, fault, or grounds for refund unless required by applicable law.
7.5 CUSTOMER ACCOUNTS
7.5.1 Customers may create accounts on the Jack's Aquatics website to facilitate purchases, track orders, manage subscriptions, and access Digital Products. Customers are responsible for maintaining the confidentiality and security of their login credentials and for all activity conducted through their account.
7.5.2 Jack's Aquatics reserves the right to suspend, restrict, or terminate accounts where there is suspected misuse, fraudulent activity, breach of these Terms, or behavior that poses operational or financial risk.
7.5.3 Customers are prohibited from creating multiple accounts for the purpose of circumventing purchase limits, subscription limits, access restrictions, claim frequency limits, or other security measures.
8. RECIPIENT ATTENDANCE AND SAFE PLACES
8.1 Live Products require in-person receipt at the delivery address unless the Customer expressly authorises an alternative delivery arrangement.
8.2 Where the Customer authorises delivery to a Safe Place, neighbor, third party, redirection address, or unattended location, risk transfers at the time and location recorded by the carrier as delivered.
8.3 Loss, theft, environmental exposure, deterioration, or damage occurring after delivery to a Safe Place, neighbor, third party, redirection address, or unattended location is excluded from Replacement Insurance eligibility unless expressly agreed in writing by Jack's Aquatics prior to Dispatch.
8.4 Where a Safe Place or third-party delivery is authorized, the Customer accepts responsibility for retrieval, environmental suitability, and security of the Products immediately upon delivery.
9. INSPECTION OBLIGATIONS
9.1 The Customer must inspect the Products immediately upon Delivery.
9.2 The standard Inspection Window is two hours from the time of Delivery as officially recorded by the carrier tracking system.
9.3 The Inspection Window begins strictly from the carrier's official delivery timestamp, regardless of when the Customer physically retrieves the parcel.
9.4 A four-hour Inspection Window applies only where valid Replacement Insurance has been purchased and supersedes the standard two-hour Inspection Window.
9.5 Inspection requires opening the package and visually assessing the contents. Receipt of the parcel without inspection does not constitute compliance with this obligation.
9.6 Any claim for replacement must be both identified and supported by the required evidence within the applicable Inspection Window.
9.7 Failure to inspect and submit compliant evidence within the applicable Inspection Window voids eligibility for replacement consideration under these Terms.
10. EVIDENCE REQUIREMENTS
10.1 Any claim for replacement must include one continuous, unedited video recording clearly demonstrating the condition of the affected Products.
10.2 The video must be a minimum of fifteen seconds per affected container and must clearly demonstrate absence of movement or viability.
10.3 The original external packaging must be shown first in the recording, followed by clear visibility of all internal packaging and contents.
10.4 The Products must remain in their original packaging at the time of recording. Any removal, transfer, acclimation, or alteration prior to recording voids eligibility for replacement consideration.
10.5 Still images, edited footage, screenshots, time-lapse recordings, or partial clips are insufficient.
10.6 All required evidence must be recorded and submitted within the applicable Inspection Window defined in Section 9.
10.7 Failure to comply with the evidence requirements set out in this Section voids eligibility for replacement consideration under these Terms.
11. REPLACEMENT INSURANCE — GENERAL RULES
11.1 Replacement Insurance is optional, chargeable, and constitutes a limited contractual remedy only.
11.2 Replacement Insurance applies solely to the specific order or subscription billing cycle for which it was validly purchased.
11.3 Replacement Insurance is non-transferable, single-use, has no cash value, and does not roll over to future orders or billing cycles.
11.4 Replacement Insurance does not convert delivery estimates into delivery guarantees and does not guarantee live arrival or survival.
11.5 Replacement Insurance does not override statutory risk transfer provisions or the risk allocation set out in Section 6 of these Terms.
12. REPLACEMENT INSURANCE COVERAGE — TRACKED 24
12.1 Where Replacement Insurance has been validly purchased for an order dispatched via Royal Mail Tracked 24, coverage includes one replacement consideration, one missed delivery consideration, no safe place cover, and a four-hour Inspection Window.
12.2 Replacement consideration under Royal Mail Tracked 24 is limited to the maximum value of the applicable Insurance Tier selected for the order and is further subject to an absolute maximum replacement value cap of £55 per order.
12.3 Where the total live goods order value exceeds £55, replacement consideration under Tracked 24 shall not exceed £55 regardless of the Insurance Tier selected.
12.4 Replacement shipments issued under Tracked 24 do not reinstate, refresh, or extend Replacement Insurance coverage.
13. REPLACEMENT INSURANCE COVERAGE — SPECIAL DELIVERY GUARANTEED BY 1PM
13.1 Where valid Replacement Insurance has been purchased for an order dispatched via Royal Mail Special Delivery Guaranteed by 1pm, coverage includes up to two missed delivery considerations, Safe Place condition review excluding theft or loss, postal delay and handling considerations, and a four-hour Inspection Window.
13.2 Replacement consideration under Special Delivery Guaranteed by 1pm is limited to the maximum value of the applicable Insurance Tier selected for the order.
13.3 Returned-to-sender orders receive no refund or replacement.
13.4 Replacement shipments issued under Special Delivery Guaranteed by 1pm do not reinstate, refresh, or extend Replacement Insurance coverage.
14. MISSED DELIVERIES AND RETURNS
14.1 Missed delivery due to recipient unavailability, incorrect address details, refusal of delivery, or failure to collect from a designated location is the Customer's responsibility.
14.2 Where an order is Returned to Sender due to recipient unavailability, refusal, address error, or non-collection, eligibility for replacement under these Terms is void and no refund shall be issued.
14.3 Where carrier tracking indicates delay, pending delivery, or non-delivery, a waiting period of three to five working days shall apply before replacement consideration is assessed. During this period, the Customer must cooperate fully with courier inquiries and provide any requested information.
14.4 Replacement consideration following delay or non-delivery is subject to carrier verification and full compliance with these Terms.
15. REFUND POLICY
15.1 Refunds are not issued except where required by statutory law or where expressly stated within these Terms.
15.2 Where Replacement Insurance has been validly purchased and all conditions within these Terms have been met, replacement is the sole contractual remedy available for live biological Products.
15.3 Nothing in this Section limits any statutory rights that cannot be excluded by law.
15.4 Goodwill gestures, discretionary replacements, or exceptions granted in individual cases do not create precedent, ongoing entitlement, or variation of these Terms.
15.5 Charge-backs, payment disputes, or third-party claims do not override these Terms. Jack's Aquatics reserves the right to provide evidence of compliance with these Terms to payment processors or dispute resolution bodies.
15.6 PAYMENT PROCESSING
15.6.1 Jack's Aquatics uses third-party payment processors including Stripe and PayPal to process payments. The Customer agrees to comply with the terms and conditions of the applicable payment provider.
15.6.2 To the extent permitted by law, Jack's Aquatics is not liable for processing errors, delays, holds, or disputes arising from third-party payment providers.
16. LIMITATION OF LIABILITY
16.1 To the maximum extent permitted by law, Jack's Aquatics excludes liability for indirect or consequential loss, economic loss, loss of livestock, loss of profits, loss of business opportunity, system contamination, and business interruption.
16.2 Subject to Sections 16.4 and 16.5, the total liability of Jack's Aquatics arising out of or in connection with any order shall be limited to the value of the Products supplied under that order, excluding delivery and Replacement Insurance fees.
16.3 Jack's Aquatics accepts no liability for loss or damage arising from the use, misuse, incompatibility, installation, acclimation, environmental conditions, or failure of any Product, including but not limited to tank instability, livestock loss, water damage, or equipment malfunction, except where such liability cannot be excluded by law.
16.4 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence.
16.5 Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.
16.6 The Customer accepts responsibility for appropriate risk assessment, acclimation, setup, monitoring, and ongoing maintenance of their aquarium system and associated equipment.
17. MISUSE, FRAUD AND ABUSE
17.1 ADVICE, GUIDANCE AND KITS
17.1.1 Any advice, guidance, recommendations, product descriptions, kits, or bundled configurations provided by Jack's Aquatics are general in nature and do not constitute professional, veterinary, electrical, or technical advice.
17.1.2 The Customer remains responsible for verifying suitability, safety, regulatory compliance, and correct application prior to use.
17.2 MISUSE AND FRAUD
17.2.1 Submission of false claims, manipulated evidence, repeated unfounded disputes, or abuse of Replacement Insurance may result in refusal of a claim, cancellation of orders, suspension of accounts, or refusal of future service.
17.2.2 Jack's Aquatics reserves the right to provide relevant evidence, including video submissions and order history, to payment processors, financial institutions, or dispute resolution bodies in the event of a dispute or charge-back.
17.3 DIGITAL PRODUCTS, COURSES, AND EDUCATIONAL CONTENT
17.3.1 Any Digital Products, courses, lesson content, educational material, or associated media supplied by Jack's Aquatics are provided for educational purposes only.
17.3.2 Jack's Aquatics makes no guarantees regarding specific outcomes, performance, system stability, livestock success, or financial results arising from application of Digital Product content.
17.3.3 Access to Digital Products may be provided via password-protected areas, automated email delivery, secure folders, or third-party platforms. The Customer is responsible for maintaining the confidentiality of access credentials.
17.3.4 Digital Products may not be copied, shared, redistributed, reproduced, resold, sub-licensed, or made publicly available without prior written consent from Jack's Aquatics.
17.3.5 Digital Products may include AI-assisted or research-based material. While reasonable efforts are made to ensure accuracy, the Customer remains responsible for independent verification and implementation.
17.4 REPEATED CLAIMS AND SERVICE RESTRICTION
17.4.1 Jack's Aquatics monitors claim frequency and dispute history across orders.
17.4.2 Where two replacement claims have been approved within a rolling six month period, further claims within that period may be subject to additional review and may be declined where risk exposure is deemed excessive.
17.4.3 Where five or more claims or disputes are submitted within a rolling six month period, Jack's Aquatics reserves the right to suspend or permanently refuse future service.
17.4.4 Any restriction or refusal of service under this Section shall be based on documented claim frequency or dispute behavior.
18. FORCE MAJEURE
18.1 Jack's Aquatics shall not be liable for any failure, delay, or inability to perform its obligations where such failure or delay arises from events beyond its reasonable control.
18.2 Events beyond reasonable control include, but are not limited to, postal strikes, carrier delays, extreme weather conditions, transport disruption, supply chain interruption, utility outages, system failures, cyber incidents, governmental restrictions, public health events, or any other unforeseen circumstance affecting operations.
18.3 Where a Force Majeure event occurs, obligations may be suspended for the duration of the event without liability.
18.4 Nothing in this Section excludes any liability that cannot be excluded by law.
19. SEVERABILITY
19.1 If any provision or part of a provision of these Terms is found by a court or competent authority to be invalid, unlawful, or unenforceable, that provision or part-provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable.
19.2 If modification is not possible, the relevant provision or part-provision shall be deemed severed and shall not affect the validity and enforce-ability of the remaining provisions of these Terms.
20. GOVERNING LAW AND JURISDICTION
20.1 These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales.
20.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms, except where mandatory consumer protection laws provide otherwise.
